Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Customer", "you") and Cursive (operated under cursive.world), the provider of the products and services described herein ("Cursive", "we", "our", "us"). By accessing or using any part of cursive.world, the PD Tracker browser extension, the Business Launcher service, or any other product offered by Cursive (collectively, the "Services"), you agree to be bound by these Terms.

If you do not agree to these Terms, do not register an account, do not install the PD Tracker extension, and do not use any Cursive Service. Continued use of the Services after any modification to these Terms constitutes acceptance of the modified Terms.

1. Acceptance of Terms

By registering an account, clicking "I agree", installing the PD Tracker browser extension, making a payment, or otherwise using any Service, you represent and warrant that:

  1. You are at least 18 years of age and competent to enter into a binding contract under the Indian Contract Act, 1872.
  2. You have read, understood and agreed to these Terms in their entirety, along with our Privacy Policy and Refund Policy, each of which is incorporated herein by reference.
  3. If you are accepting these Terms on behalf of a company, partnership, LLP, sole proprietorship or other legal entity, you have full legal authority to bind such entity, and all references to "you" shall refer to that entity.
  4. Your use of the Services will at all times comply with these Terms and all applicable laws of India and, where relevant, the laws of any other jurisdiction in which you operate.

3. Eligibility & Account

  1. You must be a resident of India and a registered seller, business entity, individual proprietor, or person carrying on a lawful commercial activity to use the paid Services.
  2. You agree to provide accurate, current and complete information during registration (email, mobile, GST details where applicable) and to keep this information updated.
  3. You are solely responsible for maintaining the confidentiality of your Account credentials, install passwords, and any password-protected files supplied by Cursive. You are responsible for all activity that occurs under your Account.
  4. Cursive may, at its sole discretion, refuse registration, suspend, or terminate any Account that we reasonably believe is being used in violation of these Terms, applicable law, or to harm the Services, other users, or any third party.
  5. One Account per person/entity. Sharing Account credentials with persons outside your organisation is prohibited.

4. Description of Services

Cursive provides software and assistance services for Indian online sellers and small businesses, including but not limited to:

Service descriptions, pricing, and features may change at any time. The most current version available on cursive.world supersedes all prior versions.

5. PD Tracker — Special Terms

The following terms apply specifically to your use of the PD Tracker extension and dashboard, in addition to all other provisions of these Terms.
  1. Customer-controlled tool. PD Tracker is software that you, the Customer, install and operate on your own computer using your own internet connection and your own browser. Cursive does not access Marketplaces on your behalf or as your agent. All Marketplace network traffic originates from your own device under your own control.
  2. Public data only. PD Tracker is designed to read only data that is publicly visible to any visitor of a Marketplace product page. It does not read, store or transmit your Marketplace login credentials, account balances, private order data, customer PII, or any non-public seller dashboard data.
  3. You select what to track. You determine which Product IDs are entered into PD Tracker. You represent and warrant that you have a legitimate business interest in tracking each listing you enter, whether as the listing owner or as a competitor in your market segment.
  4. Marketplace compliance is your responsibility. You acknowledge that some Marketplaces' Terms may restrict automated access. You are solely responsible for ensuring that your use of PD Tracker complies with the applicable Marketplace Terms, and you assume all risk arising from any alleged or actual violation of such Marketplace Terms, including suspension or termination of your seller account by a Marketplace.
  5. No guarantee of accuracy. Marketplaces change their page structures without notice. Cursive does not warrant that the data extracted by PD Tracker will be complete, accurate, or up-to-date. You should independently verify any data before relying on it for business decisions.
  6. Data ownership. The Public Product Data extracted by PD Tracker on your behalf is yours. Cursive stores it solely to provide the Service to you and to operate, monitor and improve the Service.
  7. No competitive misuse. You may not use PD Tracker to systematically scrape, mirror, redistribute, or commercially resell Marketplace product data to third parties outside your own organisation.
  8. Anti-abuse controls. Cursive implements jitter, throughput caps, sequential request patterns and other controls to ensure PD Tracker behaves as an ordinary browser session. You must not modify, reverse-engineer or disable these controls.

6. License Grant & Restrictions

  1. Subject to your continued compliance with these Terms and payment of all applicable fees, Cursive grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Services solely for your internal business purposes during the subscription/credit period for which you have paid.
  2. You shall not, and shall not permit any third party to:
    • copy, modify, translate, adapt or create derivative works of any Cursive software, extension, dashboard or content;
    • reverse-engineer, decompile, disassemble, deobfuscate or otherwise attempt to discover the source code of any compiled or obfuscated Cursive software, including but not limited to the PD Tracker extension binaries and WebAssembly modules;
    • redistribute, sublicense, sell, rent, lease, or otherwise transfer the Services or any part thereof;
    • remove, alter or obscure any proprietary notices, watermarks, branding or copyright statements;
    • use the Services to build or assist in building a competitive product or service;
    • circumvent any usage limits, row credits, password locks, or licensing controls.
  3. The PD Tracker extension binary is uniquely fingerprinted per Customer. Sharing, distributing, or republishing the extension to any person outside your registered Account is a material breach of these Terms and may result in immediate termination and a claim for damages.

7. User Obligations & Marketplace Compliance

This is the most important section of these Terms. Read it carefully.
  1. You are solely and exclusively responsible for ensuring that your use of the Services complies with all applicable laws, regulations, rules and Marketplace Terms.
  2. You acknowledge and agree that Cursive is a software and service provider, not your agent or representative. You operate the Services on your own devices under your own control. Any communication between your device and any Marketplace is initiated by you, occurs from your own IP address, and uses your own cookies and credentials (if any).
  3. You shall not use the Services in any manner that:
    • violates the Information Technology Act, 2000 or any rules made thereunder;
    • violates the Digital Personal Data Protection Act, 2023 ("DPDP Act") or any rules made thereunder;
    • infringes any intellectual property, privacy, publicity or other right of any person;
    • constitutes unauthorised access to any computer system within the meaning of Section 43 or 66 of the Information Technology Act, 2000;
    • involves attempting to overload, disable, interfere with, or disrupt any Marketplace's servers or networks;
    • defeats or attempts to defeat any Marketplace's technical access controls, including CAPTCHAs, rate limits, IP blocks, login walls, or WAF rules.
  4. You agree to indemnify and hold Cursive harmless from any consequence — including but not limited to suspension or termination of your Marketplace seller account, monetary loss, legal proceedings, or reputational harm — arising from any violation by you of any Marketplace Terms.

9. Fees, Payment & GST

  1. Fees for the Services are as published on cursive.world from time to time. All fees are stated in Indian Rupees (INR) and are exclusive of applicable Goods and Services Tax (GST), which will be added at the prevailing rate (currently 18%) at the time of invoice.
  2. Payments are processed by Razorpay, a third-party payment processor. By making a payment, you agree to the terms and privacy policy of Razorpay. Cursive does not store your payment card or bank account details.
  3. You shall provide accurate billing information including GSTIN (if you are registered) so that we may issue a tax invoice that meets the requirements of the GST law.
  4. All fees become due upon successful payment confirmation by Razorpay. A tax invoice will be issued and sent to your registered email.
  5. Cursive reserves the right to revise fees at any time. Revised fees apply to renewals and new purchases made after the revision date; existing paid subscriptions/credits remain valid for their stated duration at the price paid.

10. Subscriptions, Row Credits & Refunds

10.1 Plan structure

10.2 Row credit rules & data retention

  1. Row credits within a bulk plan (Plan 1 / 2 / 3) expire 30 days from the date of purchase. Unused credits lapse and are not refundable, transferable, or carried over.
  2. Bulk plan capacity is a ceiling, not a guarantee of usage. If you do not utilise the full capacity within the validity period, the unutilised portion is forfeited.
  3. Starter (₹5) row tracking is renewed only when you re-upload or top up; tracking is automatically suspended for any row whose 30-day window has elapsed without renewal.
  4. One-time (₹2) rows are scanned once and not refreshed thereafter.
  5. Data retention policy (all plan types):
    • One-time (₹2): Scraped data is available in your dashboard for 3 days from the date of scan completion. After 3 days, the row and its data are automatically and permanently deleted. You must download the data within this 3-day window if you wish to retain it.
    • Starter (₹5): Continuous tracking runs for 30 days from purchase. Following expiry, a 3-day grace period applies during which you may renew the row from your wallet, or download its data. On day 33 from the original purchase date, any row that has not been renewed is automatically and permanently deleted.
    • Bulk plans (Plan 1 / 2 / 3): The pack and all rows linked to it expire 30 days from the date of purchase, irrespective of how much capacity was utilised. A 3-day grace period follows expiry during which you may purchase a new pack to retain the rows, or download the existing data. On day 33 from the original purchase date, all rows belonging to the pack are automatically and permanently deleted.
  6. Deletion under the data retention policy is irreversible. Cursive does not maintain backups of deleted row data and cannot restore deleted rows on customer request. You acknowledge and accept this retention model when purchasing.
  7. Auto-deletion is the system default and applies even if you have not been notified individually. Cursive may, at its discretion, send a reminder email before deletion but is not obliged to do so.
  8. You may at any time download all current row data via the PD Tracker dashboard's Reports / Download functions, or via the dedicated download links on the row ledger. We strongly recommend periodic downloads if you wish to retain historical data outside of the Service.

10.3 Refund Policy

All sales are final. Once payment is successfully processed, fees are non-refundable except in the following limited circumstances:

Refund requests must be raised in writing to support@cursive.world with the transaction ID. Approved refunds will be processed within 7–10 business days via the original payment method. Cursive's decision on refund eligibility is final and binding.

11. Data, Privacy & Confidentiality

  1. Cursive's collection, use, storage and disclosure of personal data is governed by our Privacy Policy, which forms an integral part of these Terms.
  2. We will not sell or rent your personal data to third parties.
  3. Data hosted on Cursive's systems is stored on Supabase (or equivalent infrastructure) located in India / supported regions. Cursive employs reasonable security measures including encryption-in-transit (TLS) and access controls.
  4. Notwithstanding the above, you acknowledge that no transmission over the internet or method of electronic storage is 100% secure. To the extent permitted by law, Cursive disclaims liability for any unauthorised access to or use of your data resulting from circumstances beyond Cursive's reasonable control.
  5. You shall keep confidential any non-public technical, commercial, or operational information about Cursive that you obtain through your use of the Services, including any non-public APIs, internal endpoint behaviour, or unreleased features.

12. Intellectual Property

  1. All right, title and interest in and to the Services, including all software, source code, compiled binaries, WebAssembly modules, dashboards, content, designs, trademarks ("Cursive", "PD Tracker", logos, and related marks), documentation and any derivative works thereof, are and shall remain the exclusive property of Cursive and its licensors.
  2. Nothing in these Terms grants you any right, title or interest in any Cursive intellectual property other than the limited license expressly set forth in Section 6.
  3. You retain ownership of the data you upload (such as your product IDs and seller information) and grant Cursive a worldwide, royalty-free, non-exclusive licence to use, store, process and transmit such data solely as necessary to provide the Services.
  4. If you provide Cursive with feedback or suggestions regarding the Services, you grant Cursive a perpetual, irrevocable, worldwide, royalty-free licence to use such feedback for any purpose, without compensation or attribution.

13. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the maximum extent permitted by applicable law, Cursive expressly disclaims all warranties, whether express, implied, statutory or otherwise, including without limitation:

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURSIVE'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES ACTUALLY PAID BY YOU TO CURSIVE IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

In no event shall Cursive, its directors, employees, agents, affiliates or licensors be liable for any:

The limitations in this Section 14 apply whether the alleged liability is based on contract, tort (including negligence), strict liability or any other theory, and whether or not Cursive has been advised of the possibility of such damages.

15. Indemnification

You agree to defend, indemnify and hold harmless Cursive, its directors, employees, agents, affiliates, contractors and licensors from and against any and all claims, demands, suits, actions, proceedings, damages, losses, liabilities, costs and expenses (including reasonable attorneys' fees) arising out of or relating to:

Cursive reserves the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us, and you agree to cooperate with Cursive's defence of such claims.

16. Suspension & Termination

  1. Cursive may suspend or terminate your access to the Services, in whole or in part, with or without notice, if we reasonably believe that:
    • you have violated these Terms or any applicable law;
    • your use of the Services is harmful to Cursive, other users, or any third party;
    • your Account has been compromised;
    • continued provision of the Services is no longer commercially or legally viable.
  2. You may terminate your Account at any time by writing to support@cursive.world. Termination does not entitle you to a refund of any prepaid fees except as expressly provided in Section 10.3.
  3. Upon termination, your right to access the Services ceases immediately. Sections 6, 11, 12, 13, 14, 15, 17, 18 and any other provisions which by their nature should survive termination shall survive.
  4. Cursive may delete your data 90 days after termination. You should download any data you wish to retain before termination.

17. Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of India. Subject to Section 18 (Dispute Resolution), the courts at New Delhi, India shall have exclusive jurisdiction over any matter arising out of or in connection with these Terms.

18. Dispute Resolution

  1. Good-faith negotiation: Before initiating any formal proceedings, the parties shall attempt in good faith to resolve any dispute by negotiation. The aggrieved party shall send a written notice describing the dispute to support@cursive.world, and the parties shall have 30 days from such notice to resolve the matter.
  2. Arbitration: Any dispute not resolved through negotiation shall be referred to and finally resolved by arbitration administered under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by Cursive. The seat and venue of arbitration shall be New Delhi, and the language of arbitration shall be English. The arbitral award shall be final and binding on the parties.
  3. Interim relief: Notwithstanding the foregoing, either party may seek interim or injunctive relief from a court of competent jurisdiction at New Delhi to protect its rights pending arbitration.

19. Changes to These Terms

Cursive reserves the right to modify these Terms at any time. We will notify you of material changes by posting the revised Terms on cursive.world with an updated "Last updated" date and, where appropriate, by sending an email to your registered email address. Your continued use of the Services after such notification constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, your sole remedy is to discontinue use of the Services.

Severability & Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable by any court or tribunal of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it enforceable, preserving the original intent of the parties to the maximum extent possible.

These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Cursive concerning the Services and supersede all prior or contemporaneous agreements, representations or understandings, whether written or oral, relating to the same subject matter.
